Terms of Service
1. Acceptance of Terms
By accessing and using the SmartCRM platform ('Service'), you agree to comply with these Terms of Service. If you do not agree to any part of these terms, you must not use our Service. Continued use of the platform implies acceptance of any changes made to these terms.
2. Use of Service
You are responsible for maintaining the confidentiality of your account and password. SmartCRM is not liable for any loss resulting from unauthorized use of your account. You agree not to use the Service for illegal or unauthorized purposes, and not to violate any laws in your jurisdiction.
3. User Responsibilities
You agree not to: (a) modify, adapt or hack the Service; (b) attempt to gain unauthorized access to our systems or networks; (c) transmit any worms or viruses or any code of a destructive nature; or (d) reproduce, duplicate or copy any portion of the Service without our express permission.
4. Plans and Payments
Some features of the Service are billed. By selecting a paid plan, you agree to pay the applicable fees. In compliance with Art. 49 of the Consumer Protection Code (CDC), we guarantee a full refund in case of withdrawal within 7 (seven) calendar days after the initial subscription.
5. Intellectual Property
The Service and its original content, features, and functionality are and will remain the exclusive property of SmartCRM and its licensors. The Service is protected by copyright, trademark, and other laws of both Brazil and foreign countries.
6. Termination
We may terminate or suspend your access to the Service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms. All provisions of the Terms which by their nature should survive termination shall survive termination.
7. Limitation of Liability
In no event shall SmartCRM, its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses.
8. Changes to Terms
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material we will try to provide at least 30 days notice prior to any new terms taking effect.
